These Terms of Service (the “Terms”) govern your access to and use of NailMyPay (the “Service”), operated by NailMyPay (“NailMyPay,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. What NailMyPay is
NailMyPay is software that helps subcontractors prepare monthly progress-billing pay applications in an AIA-style G702/G703 format. The templates we provide are our own. They are not the American Institute of Architects’ official G702 or G703 documents, and NailMyPay is not affiliated with, endorsed by, or sponsored by the AIA. We describe our output as “AIA-style” to signal a familiar format, not any affiliation. You are responsible for confirming that the format we produce is acceptable to the general contractor, owner, or other party you submit it to.
2. What we promise, and what we don’t
NailMyPay runs a submission check that looks for the errors we can catch by math and structure: that your line items add up, that your numbers stay within the contract, and that the document follows the expected format. When that check passes, your pay application should not bounce on one of those errors. That is the scope of our promise.
We do not guarantee that your pay application will be paid, approved, or accepted. The percentage of work complete is your judgment as the subcontractor, and approval is the general contractor’s or owner’s decision. Neither is something NailMyPay controls or warrants.
3. Not professional advice
NailMyPay is a document-preparation tool, not a professional adviser. Nothing in the Service is legal, financial, tax, accounting, or contract advice, and you should not rely on it as such. For advice about your contracts, lien rights, taxes, or books, consult a qualified professional.
4. Your account
You need an account to use the Service. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that happens under your account. Tell us promptly at support@nailmypay.com if you believe your account has been used without your permission.
An account is for a single subcontracting business. The team members you invite — office or field — must be people working for that business on its jobs, and you are responsible for everything they do under your account. Do not use one account to prepare or submit pay applications on behalf of separate, unaffiliated businesses; each business needs its own account and subscription. We may suspend accounts we reasonably believe are being shared across unrelated businesses.
5. Accuracy of what you submit
You are solely responsible for the accuracy and completeness of everything you enter and everything you submit: contract sums, schedule-of-values line items, quantities, percentages complete, retainage, and any supporting documents. NailMyPay checks internal consistency and format; it does not verify that your figures reflect the work actually performed or the terms of your contract. Review every pay application carefully before you send it.
6. Free first pay application and subscription
Your first pay application is free. Continued use of the Service beyond that requires a paid subscription. We offer two plans — Core, for a solo subcontractor, and Pro, which adds team access and other features — each billed monthly or annually. Current prices are shown on our pricing page and at checkout, and are stated exclusive of any applicable taxes; we may change our prices on a going-forward basis with reasonable notice.
7. Billing and cancellation
Paid subscriptions are billed in advance through our payment processor on a recurring basis, monthly or annually depending on the plan you choose, and renew automatically until you cancel. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you keep access until then. Payments already made for the current period are non-refundable, except where a refund is required by law.
8. Acceptable use
You agree to use the Service only for lawful purposes and only for pay applications you are authorized to prepare. You agree not to:
- enter figures you know to be false, or use the Service to prepare a pay application you know to be fraudulent;
- upload content you do not have the right to use, or that infringes someone else’s rights;
- attempt to access another account or data that is not yours;
- interfere with, disrupt, reverse engineer, or place an unreasonable load on the Service;
- resell or redistribute the Service without our written permission.
9. Your content
You keep ownership of the data and documents you put into the Service. You grant us the limited right to store and process that content so we can provide the Service to you, for example to generate your pay applications, run the submission check, and translate the line items you enter. Our Privacy Policy explains how we handle your data.
10. Warranty disclaimer
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that its output will meet the specific requirements of any given general contractor, owner, or project.
11. Limitation of liability
To the fullest extent permitted by law, NailMyPay will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost payments, or lost data, arising out of or relating to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where the changes are material, provide additional notice. Your continued use of the Service after the changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. The state and federal courts located in Georgia will have jurisdiction over any dispute that is not otherwise resolved.
